4. General Rules (Applicable to All Licenses)
4-1. Client Delivery Rules
Any file delivered to a client must satisfy all of the following conditions:
- Non-editable raster image files such as JPG or PNG
- Fully rasterized, non-editable, non-layered PDF files
The following are prohibited:
- PSD files or any file containing layers
- Sharing files in any editable format
4-2. Definition of Paid Advertising
The following shall all be deemed paid advertising:
- Purchasing exposure through advertising spend
- Sponsored posts or boosted posts
- Performance marketing campaigns
- Affiliate marketing or influencer sponsorships involving monetary compensation or any other form of consideration
- Outdoor advertising and broadcast advertising
4-3. AI Use Guidelines
- Permitted
- Partial edits made in the course of design work using generative AI tools (for example, Photoshop Generative Fill) are permitted, including changing certain props within the mockup, extending the background, color correction, or partial retouching.
- Prohibited
- Training and dataset use prohibited
- The product may not be used as a source for AI model training, machine learning, dataset creation, model fine-tuning, or algorithm improvement.
- This includes, without limitation, use for LoRA, embeddings, fine-tuning, synthetic dataset generation, retrieval corpus construction, or any other training-related or data utilization purpose.
- Reference-based generation and input use prohibited
- The product may not be used as an input to any generative AI tool.
- This includes, without limitation:
- image-to-image workflows
- reference image input
- condition-based generation such as ControlNet
- any other workflow that generates output based on the structure or composition of the product
- Any use that goes beyond mere inspiration and materially influences the generated output shall be deemed prohibited.
- Prohibition on similar output generation and structural reproduction
- Users may not generate outputs that substantially reproduce or closely imitate the composition, lighting, object placement, angle, or structural elements of the product.
- This restriction applies regardless of the tool or method used, including whether the original product was directly input into the system.
- If the resulting output is visually similar to, or has a substantially identical structure as, the original product, it may be deemed an unauthorized reproduction regardless of intent.
- Interpretation of prohibited scope
- Any AI-assisted use intended to generate “similar images” based on the product is prohibited.
- Similarity shall be determined comprehensively based on core visual elements, including composition, lighting, placement, and object configuration.
- Even where the user did not directly input the original image, the use may still be deemed a violation if the resulting output substantially reproduces or closely imitates the original product.
4-4. No Resale or Transfer of Rights
The following are prohibited:
- Reselling or redistributing the product, in whole or in part
- Reworking the product into a template, asset, or similar item for sale
- Misrepresenting oneself as the original author
- Assigning, reselling, sublicensing, or otherwise transferring license rights to any third party
5. License Verification and Enforcement
5-1. Verification of License Rights
Scenenumber may request verification of license validity in the following cases:
- Where use beyond the licensed scope is suspected
- Where unauthorized distribution or reproduction is suspected
- Where the purchaser and the actual user appear not to match
5-2. Method of Notice
Official Channels
Where license verification is required, Scenenumber may deliver official notice to the user through the following channels:
- The email address provided at the time of purchase, which shall be treated as the primary official contact channel
- The contact information registered in the user account, as provided during account registration
Supplementary Contact Methods
If it is difficult to reach the user through official contact channels such as email, or if communication is not proceeding properly, Scenenumber may also attempt to contact the user through the following methods:
- Direct messages (DMs) or public comments on social media, through official accounts on platforms where the relevant work is posted, including Instagram and Behance
Such methods are used only as supplementary means of requesting contact and do not constitute formal legal notice.
If the user becomes aware of such a request, the user must respond through the official contact channel designated by Scenenumber, such as email.
5-3. Right to Take Immediate Action
Scenenumber may take any necessary protective measures, with or without prior notice to the user and regardless of whether the user has responded, in the following circumstances:
- Where use beyond the licensed scope is reasonably suspected
- In making such determination, Scenenumber may consider public usage examples, scale of exposure, method of use, purchase history, and other relevant circumstances
- Where no valid purchase history can be confirmed
- Where unauthorized distribution, resale, or visual reproduction is suspected
In such cases, Scenenumber may immediately take action including, without limitation:
- Requesting removal of content under applicable platform policies (including DMCA procedures) on platforms such as Behance or Instagram
- Requesting restriction or suspension of use
- Requiring additional license purchase or verification
5-4. User Duty to Cooperate
If Scenenumber makes a request related to license verification, the user must cooperate within a reasonable scope and, upon request, provide purchase records, order information, or other materials capable of proving authorized use.
If the user fails to cooperate with such request, Scenenumber may treat the relevant use as unlicensed and may maintain or expand the measures it considers necessary.
6. Corporate License
If the user is an organization with more than 50 employees, or requires special terms outside the standard license scope, a separate quotation and custom license must be obtained by contacting Scenenumber directly at the designated email address.
Free Mood Shot License
1.Eligibility (End User Basis)
These mood shots are provided free of charge to users who have purchased any Scenenumber paid mockup product (Portfolio, Commercial, or Commercial Plus license).
- All paid product purchasers may download and use these images, regardless of license tier.
- This license applies based on the end user entity, not the purchaser.
2.Permitted Uses
- Images may be used for personal, commercial, and editorial projects.
- Modifications, edits, and adaptations are allowed.
- Use in digital and print media is permitted, including websites, social media, advertisements, and presentations.
3.Prohibited Uses
The following uses are strictly prohibited:
- Reselling, redistributing, or sublicensing the images, whether in original or modified form
- Creating or selling derivative products such as templates, assets, mockups, or resource packs
- Using the images, in whole or in part, as standalone products for distribution
- Claiming authorship or ownership of the images
- Using the images in connection with hate speech, violence, or illegal activities
4.AI Usage Restrictions
Permitted:
- Limited edits as part of the design process (e.g., color correction, background adjustments, retouching)
Prohibited:
- Use for AI training, dataset creation, model fine-tuning, or similar purposes
- Input-based generation workflows (e.g., image-to-image, ControlNet, or similar tools)
- Use in model training processes (including LoRA, embeddings, or fine-tuning)
- Generating outputs that replicate or closely resemble the composition, structure, or visual setup of the original image
※ Outputs that are substantially similar may be considered a violation.
5.Attribution
- Attribution is not required, but appreciated :)
6.Limitation of Liability
- Scenenumber shall not be held liable for any legal claims arising from the use of these images.
- Users are solely responsible for ensuring that their use complies with applicable laws and regulations.
- This limitation of liability applies to the maximum extent permitted by law.
